The user agrees to comply with the present general conditions and to use the web page, Services and its content according to these terms. The user agrees that the use of the site and any of its Services and content is at his/her own and exclusive risk.

Modification of these terms of use

FITMAN reserves the right to make any changes it considers necessary to the Terms of Use, without prior notice. The user is responsible for reviewing these new terms every time s/he wishes to visit the web page.

FITMAN reserves the right to refuse or withdraw access to the Page and/or the Services, at any time without prior notice to the users who violate these General Terms or any other Individual ones to whom the Terms apply.

Intellectual property and/or industrial property

Todos los derechos de propiedad industrial e intelectual de esta Página y de sus contenidos (textos, logos, iconos, imágenes, sonidos, audio, vídeo, software...) pertenecen a FITMAN o, en su caso, a terceras personas. El usuario puede visualizar todos los elementos, imprimirlos, copiarlos y almacenarlos en el disco duro de su ordenador o en cualquier otro soporte físico siempre y cuando sea, única y exclusivamente, para su uso personal y privado, quedando, por tanto, prohibida su utilización con fines comerciales, su distribución, así como su modificación, alteración o descompilación.

The user can view all items, print, copy and store them on the hard disk of his/her computer or any other physical medium, provided it is done solely and exclusively for their personal and private use; it is therefore forbidden to process, distribute, disclose, disseminate or otherwise exploit them, or modify, alter or decompile them. Users must not obtain, or even try to obtain information, messages, graphics, sound files and/or images, photographs, recordings, software, and generally any kind of material accessible through this page (hereafter the "Content") using means or procedures other than the ones that have been made available for this purpose or that are indicated expressly in the web Page or, in general, other than the ones regularly used on the Internet to this effect as long as they do not pose a risk of damage or of being rendered useless to the Page, the Services and/or the Content.

FITMAN does not grant any license or express or implied rights of use of any kind on its intellectual and / or industrial property rights or other property or right related to the Page, Services or Content, except by written agreement between the parties.

The diffusion of the Contents and of the information provided is prohibited

The User undertakes to use the Content in a diligent, correct and lawful manner, and in particular, agrees to refrain from:

  1. Using the Content whether in whole or in part, for purposes or effects that are against the Law, morality and generally accepted good practices;
  2. Reproducing or copying, distributing, allowing public access via any means whatsoever of public communication, transforming or modifying the Content, unless it is with authorisation of the owner of the corresponding rights or unless it be legally permissible;
  3. Removing, avoiding or interfering with the “copyright” and other data identifying the rights of FITMAN or its owners included in the Content, as well as with the technical protection devices, digital fingerprints or any other information mechanisms contained in the Content;
  4. Using the Content and, in particular, information of any kind obtained through the Page or from the Services to send publicity, communications for any purpose, unsolicited messages directed to a group of persons, regardless of the objective, as well as refraining from selling or divulging the said information in any manner or form.
  5. Concealing the origin of the information transmitted via the site.
  6. Placing false or misleading information on the site.
  7. Entering or uploading information that contains viruses, Trojan horses, worms or other harmful components designed to damage, intercept, expropriate or interfere with the system, the site or the information, or that infringes the intellectual property rights of another.
  8. Using the site or FITMAN systems or services in any way that adversely affects the performance or function of the MRW Systems, Services or the site or interferes with the ability of authorized parties to access the MRW Systems, Services or the site.

FITMAN shall pursue any lack of compliance of the before named conditions and any improper use of the Content presented at their headquarters and exert all the civil and penal actions that could correspond to them by law.

FITMAN shall not recognize the validity of any reproduction or disclosure of Content of its site.

Inserting Links or Hyperlinks

The User and, in general, those who intend to establish a link between their website and the Page (henceforth the "Hyperlink"), notwithstanding that FITMAN reserves the right to refuse at any time, must comply at least to the following conditions:

  1. The Hyperlink will only allow access to the Page, but will not reproduce it in any way;
  2. Will not create a browser or border environment around this Page;
  3. Will not make any false, inaccurate or incorrect statements or indications about the Page and the Services and, in particular, will not declare or imply that FITMAN has authorized the hyperlink or has supervised or assumed in any way the contents or services offered or made available to the web page establishing the Hyperlink;
  4. Except for those signs that are part of the Hyperlink, the web page where the Hyperlink is established will not contain any trademark, trade name, label, name, logo, slogan or other distinctive signs belonging to FITMAN;

The website on which the Hyperlink is established shall not contain illicit or illegal information or content, contrary to general good faith and public order, or be harmful to the rights and interests of third parties. The establishment of the Hyperlink does not imply in any case the existence of a relationship between FITMAN and the owner of the website on which it is established, or the acceptance and approval by FITMAN of its contents or services.

Personal Data

To use certain Services, users must first provide FITMAN with specific personal information. The user agrees that by providing any personal information through the site s/he consents to the transmission of such personal data. FITMAN shall use this personal data to maintain customer relations and in accordance with current legislation.

Under current legislation, users who have provided personal information to FITMAN have the following rights:

  1. The right of access: The right to request and obtain free information regarding their personal data under treatment, the source of such data and any past or future communication undertaken or planned. This right may be exercised at most once every 2 months, unless a legitimate interest is established.
  2. Right of rectification and cancelation. The right to modify or cancel any personal data which does not comply with the law, in particular those resulting inaccurate or incomplete.
  3. The right to object: The right to oppose the treatment of personal data. This right entails the possibility of rescinding the personal data provided.
  4. The right to object implies termination of the relations between FITMAN and the users by virtue of which the data was transmitted.

Disclaimer of liability and warranty

FITMAN does not guarantee the continuity, availability and use of the site, the Services and the content. Therefore, it is not responsible for any potential loss or damage of any kind that may arise from the use of the site.

FITMAN reserves the right to cancel or suspend the use of the site, the information, the Services and the content when it deems it necessary, in its absolute discretion, even if it allows other users to access and use the site. FITMAN shall not be responsible before you or third parties for cancelling or suspending your access to the site, the information and/or the Services.

FITMAN shall in no event be liable for delays or failures in performance resulting directly or indirectly from natural disasters, forces or causes beyond its control, including, without limitation, Internet failures, computer failures, telecommunications equipment failures, other equipment failures, power failures, strikes, labour disputes, riots, lack of materials or labour force, fires, floods, storms, explosions, war or similar causes.

In no event will FITMAN be liable to any user for any damages, whether direct, indirect, incidental or consequential, arising out of the use or inability to use the site. In particular, FITMAN shall not be liable for lost profits, loss of confidential or other type of information, business interruption, damage to persons, loss of privacy, failure to fulfill obligations, negligence, alterations or elimination of databases, or any other loss, pecuniary or otherwise, or of any other kind.

FITMAN does not guarantee the absence of viruses or other elements that may cause alterations in the users’ computer system or in electronic documents or files stored in them.

FITMAN does not guarantee or assume any type of responsibility for damages of any kind caused by:

  1. The performance, availability, accessibility or continuity of linked web sites;
  2. The maintenance of the Services, information, data, files, products and any type of existing material in the linked web sites;
  3. The delivery or transmission of the Services, information, data, files, products and any type of existing material in the linked web sites;
  4. The quality, legality, reliability and usefulness of the Services, information, data, files, products or any kind of material on the linked sites in the same terms and with the same scope as stipulated in clause 10.2 regarding the Content and Services provided by third parties through the web.

As well as those caused by misuse or reproduced, in whole or in part, for any purpose without express written permission.

Privacy and security in the use of the Page and the Services

FITMAN does not guarantee the privacy and security of the use of the Page and the Services and, in particular, does not guarantee that unauthorized third parties may be aware of the nature, conditions, characteristics and circumstances of the use made by users of the Page and the Services.

FITMAN disclaims any responsibility for damages of any kind which may be due to knowledge unauthorized third parties might acquire regarding the type, conditions, characteristics and circumstances of the use made by users of the page and the Services.

Duration and termination

The provision of the Page service and other Services is, in principle, of an indefinite duration. FITMAN, however, is authorized to terminate or suspend the provision of the Page service and/or of any of the Services at any time, without prejudice to what is defined in the corresponding Individual Terms. Whenever reasonably possible, FITMAN shall give prior notice of the termination or suspension of the Service of the Page and other Services.

Acceptance of the current General Conditions

The acceptance of these Terms by users is a compulsory indispensable prerequisite to, where appropriate, benefit from the Services of the site. Users declare, under their responsibility, to have read the General Conditions of Access and Use of the Page in full, and confirm their complete and voluntary acceptance thereof.

Clause on data compilation through the web page

The data requested from individuals is used to provide the contracted service, manage the corresponding promotion, suggestion or claim. This data will be part of a file owned by FITMAN, and may be used to keep you informed by post, telephone or telematics, of the Services and promotions of MRW, and to conduct surveys on the quality of the Service. Applicable law and jurisdiction

These Terms of Use are governed by Spanish law. The User and FITMAN, waiving their own jurisdiction, submit to the courts of the city of Barcelona (Spain).
